To underscore our commitment to privacy and our vision that good privacy is good business, we have adopted this Online Privacy Policy for EZLaw.com (“our site”) and its mobile application equivalents. Our site is owned or operated by EZLaw Inc. (“EZLaw”).

This Online Privacy Policy only applies to information collected through our site. It does not apply to information collected in any other way, including information collected offline. Other Web sites may operate under their own online privacy policies. Our site is not directed at children or individuals under the age of 13.

INFORMATION COLLECTION

I. Account Information; Customer Confidential Information

In the course of using the EZLaw™ Services, you (or your Participating Attorney) may provide us with at least two different types of information: Account Information and Client Confidential Information. While either type of information may be “Personally Identifiable Information” under federal or state law or as this and other Web sites define the term, we treat them differently under this Online Privacy Policy, so it is important that you understand the distinction.

“Account Information” is the information you provide to us in registering for the EZLaw Services and helping us deliver the EZLaw Service to you. Account Information may include, for example:

• Contact information such as your name, mailing address, e-mail address, telephone number(s) or, fax number(s);
• Billing and payment information, such as credit card information, billing address and billing phone number;
• Information concerning your order for EZLaw Services, including but not limited to the types of documents you ordered, and the identity of the Participating Attorneys you select through the EZLaw Service; and updates to any of the above.

“Customer Confidential Information” means the information, excluding Account Information, that you (or your Participating Attorney) may provide that relates directly to the production of the Documents you ordered or the provision of the Legal Services by the Participating Attorney. Customer Confidential Information includes:

• Data and information you enter In the course of using the EZLaw Services, after you registered to use those services, relating to the choices you wish reflected in your documents. This information will vary according to the document for which you have subscribed. For example, in connection with a will, Customer Confidential Information might include, among other things, the identities of your executor and beneficiaries and descriptions of the property included in your bequests. In the context of a power of attorney, Customer Confidential Information might include the identity of your attorney-in-fact, the scope of the attorney-in-fact’s powers and the instructions you have provided. In the context of a living will, Customer Confidential Information might include your instructions relating to healthcare services.
• All Documents and Legal Documents produced in the course of providing the EZLaw Services;
• Any information or communications you and a Participating Attorney may exchange over the password protected portion of our site.

II. Other Personally Identifiable Information

Personally identifiable information (“PII”) refers to information that can be used to uniquely identify, contact, or locate a single person or can be used with other sources to uniquely identify a single individual. In addition to the Account Information and Customer Confidential Information described in the preceding section, we collect a couple other types of PII. First, we collect other information that you choose to provide through our site. This may include, for example, any responses you choose to provide to survey questions, information provided in connection with subscribing to a newsletter, any inquiries you may make through our site, any testimonials or referral you may provide to us, or any other PII you provide to us through our site.

In addition, we collect information, including PII, in connection with attempts to log-in to our products and services through our site and the actions taken by users while they are logged into our online products and services. This may include, for example, collecting information pertaining to searches conducted, the pages visited during the online session, and any or all other interactions that the user may have with our systems while the user is logged into one of our products or services.

III. Cookies and Other Technologies

Our site may use browser “cookies”, local shared objects (also known as “Flash cookies”) and other technologies such as web beacons, tracking pixels and clear gifs.

Browser cookies are small pieces of information that are stored by your browser on your computer. Browser cookies, for example, may be used by our site to help us manage your visit to our site, to facilitate the display of advertising, or to determine whether a visitor is unique or whether a visitor has viewed our site before. While most browsers are set to accept cookies by default, you can set yours to refuse cookies or to alert you before accepting them. Your browser manufacturer has information on changing the default setting for your specific browser. Deleting or refusing to accept cookies from our site, however, may limit your ability to use some portions of our site which require the use of cookies to operate effectively.

Our site may also use Flash cookies to store your preferences, facilitate advertisements, or display content based upon what you view on our site to personalize your visit. Flash cookies are different from browser cookies because of the amount, type and manner data is stored. Cookie management tools provided by your browser will not remove Flash cookies. Third parties, with whom we may have alliances with to provide certain features on our site or to display advertising based upon your browsing activity, may use browser cookies, Flash cookies and other technologies to collect and store information.

IV. Non-personally Identifiable Information

Our site may also collect non-personally identifiable information. For example, as you browse our site we may collect information about your visit. Web server logs may monitor statistics such as: the number of people that visit our site, which page(s) are visited on our site, which domains our visitors use (e.g., google.com, microsoft.com), and which browsers people use to visit our site (e.g., Apple Safari, Microsoft Internet Explorer, etc.). We also may compile statistics that show the numbers and frequency of visitors to our site and its individual pages. These aggregated statistics may be used internally to improve our site and for product development and marketing purposes generally. Those aggregated statistics may also be provided to advertisers and other third parties, but again, the statistics contain no PII.

Our site also may use third party programs and services to assist us in analyzing this data to better our site.

INFORMATION USE AND CONSUMER CHOICE

I. Customer Confidential Information.

Our site stores Customer Confidential Information solely for the convenience of our customers. Your Customer Confidential Information remains your sole property at all times. The section of this Online Privacy Policy entitled “Onward Transfer” and the remainder of this section, “Information Use and Customer Choice,” do not apply to Customer Confidential Information. EZLaw, except as described below, does not access or use Customer Confidential Information for any purpose other than to generate (automatically and without human intervention) the Documents you order. Customer Confidential Information will be forwarded only to an EZLaw Participating Attorney and solely for providing Legal Services; we will forward Documents, Legal Documents and other Customer Confidential Information to third parties only on your instructions.

There are several limited exceptions to the foregoing policy. First, EZLaw technical personnel and contractors may be granted access to the forms and documents containing Customer Confidential Information solely in the course of servicing the website, servers or software. Second, you may be asked to grant EZLaw customer service personnel access to your forms or documents in order to help trouble-shoot technological problems you are experiencing in using the service. The third exception relates to legal proceedings or government investigations. If we receive a subpoena or other validly issued administrative or judicial process compelling us to produce your Customer Confidential Information, and if we are permitted by law to disclose it, we will promptly notify you and, if you have retained one, your Participating Attorney. Unless you or the Participating Attorney timely succeeds in limiting, quashing or extending the time within which we may respond to the demand, we will be entitled to comply with the demand to the extent required by law.

Please note, that the use, maintenance, and disclosure of information that we make accessible to the Participating Attorney(s) will be the responsibility of the Participating Attorney consistent with their legal and ethical obligations. EZLaw is not responsible for the information once it is transferred to the Participating Attorney(s).

II. Other Information

This Section II applies to Account Information and other information that does not constitute Client Confidential Information.

Administrative uses.

The information collected by our site and its mobile application equivalents may be used for responding to your inquiries and otherwise corresponding with you, for processing transactions you request, maintaining your account (if you have one), for other purposes permitted by the terms and conditions of your participation in the EZLaw Services. (if any) for products and services, to maintain the security and integrity of our sites, products and services, for the purpose of conducting market research or surveys on behalf of EZLaw and its affiliates and for the administration, review and/or the improvement of the content of our sites, products or services.

We may use information about searches or submissions (excluding Customer Confidential Information) that users provide to us as part of our customer care functions to contact you in response to your comments or inquiries, as part of the maintenance of your account with us (if you have one), or in order to complete a transaction that you requested. In addition, we may also use this type of information to enhance our products and services.

Marketing uses and choices.

We give you a number of choices regarding how we may use and disclose your information for marketing purposes. This section provides you with additional information about those choices. You can exercise many of these choices by visiting our site’s My Account page.

We may contact you to inform you of other products or services we believe may be of interest to you. If you decide that you do not want to receive such marketing communications about other products or services, you can reply to the e-mail or use the opt-out mechanism provided in the communication with a request that we do not continue to contact you.

We also may disclose personal information you provide to us in your account (but not Customer Confidential Information) to third parties so that they can contact you about products or services that may be of interest, but we will provide you with an opportunity to not to have your information disclosed for these purposes. If you would like to opt out of some or all disclosures of this information, please login to your account and set your preferences by visiting the My Account page on our site.

Our site uses third-party advertisers, advertising companies and advertising networks (collectively “Advertisers”) to serve ads and collect information when you visit our website. Advertisers may use information (not including your name, phone number or email address) about your visits to this and other websites in order to provide advertisements on this and other websites about goods and services that may be of interest to you. Advertisers may change from time to time at the sole discretion of EZLaw. We may enhance or merge your information collected on our site with data from third parties for purposes of improving your experience or marketing products or services to you.

Refer-Another Option.

We may offer you the “Refer-Another” (e.g., friend, colleague or family member) option to refer our site or information about our products and services to others. If you choose to use our Refer-Another option, we will ask for the referred person’s name and e-mail address. We will automatically send the referred person a one-time e-mail message and no more than two follow up reminders with information about the product or service and/or inviting the person to visit our site. The referred person will have the ability to opt out of these reminders. The message may include your name and/or e-mail address and any optional message that you elect to send along with our e-mail. We will not retain the information that you provide as part of the EZLaw Services (although we may retain the referred person’s e-mail address to send them reminders as described above or if additional information or e-mail messages are requested from us).

ONWARD TRANSFER

This Section on Onward Transfer applies to Account Information and other information that does not constitute Client Confidential Information.

We may disclose information you provide to us to third parties in order to complete a transaction that you requested or as otherwise permitted by your Terms and Conditions.

We may also outsource some tasks, including the operation of certain Web site functions that require access to information you supply online and information about your visits to our site. In such cases, however, we require that the companies acting on our behalf to institute safeguards to protect the confidentiality of your information.

We may offer contests or other promotions through our site in conjunction with third parties. If you chose to participate in any promotion or contest, the information you provide may be shared with our third party alliance entities for that promotion and their handling of the personal information provided will be subject to their own privacy policy.

We may disclose information to third parties for marketing purposes. For information regarding your choices about marketing, please see the Information Use and Consumer Choice section above.

If our company or our assets are acquired by another company, that company will assume responsibility for the personal information collected by us through this our site and it will assume the rights and obligations regarding the information collected through our site, as described in this Online Privacy Policy.

If you choose to make information available to other people through instant messages, group chats, electronic mail messages, blog postings, your social networking profile (if any), registering for an event, or by joining groups or using other networking or communications functions that we may offer on our site or through our mobile applications, this information will be visible to third parties. Please take care in deciding what information you choose to make available through these mechanisms, as we do not control the manner in which recipients or persons who may see the information may use or re-disclose the information that you choose to provide. We may also allow you to log into our site using your user ID and password for third-party sites such as Facebook and Twitter. If you use this functionality, we will need to provide information to the third party site to validate your login credentials.

Finally, please note that we may disclose personal information when required by law or in the good faith belief that such action is necessary in order to comply with the law or legal process or is pertinent to judicial or governmental investigations or proceedings.

ACCESS AND CORRECTION

With respect to Customer Confidential Information, we will continue to store that information for a period of one year from the date of your last login. We also retain the completed legal documents after attorney review for a period of one year from the date of purchase.

We strive to maintain the accuracy of the PII collected through our site. We will provide you (whether you are a consumer or a customer) with access to PII you provide through our site for as long as we maintain that information in a readily accessible format. We will also work with you to correct any PII you submitted to us.

If you wish to access PII that you have submitted through our site or to request the correction of any inaccurate PII you have submitted through our site, please use the mechanisms provided by our site or send an e-mail to: Privacy@EZLaw.com

The access and correction provisions of this Online Privacy Policy only apply to PII collected from you through our site.

SECURITY

We have put in place administrative, technical and physical safeguards designed to protect the information that we collect from you through our site. In the event we request or transmit sensitive information, such as credit card information or Social Security Numbers, our processes are designed to use industry standard, secure socket layer (“SSL”) encryption. We also limit access to Customer Confidential Information, as specifically described above, solely to those employees who need access in order to carry out their responsibilities with respect to the EZLaw Service.

We need your help to keep your information secure. Remember to be vigilant of your security and use common sense security practices, such as protecting your user IDs and passwords and installing anti-virus software on your computers. Be aware of popular identity theft and fraud scams. We do not solicit any Customer Confidential Information or sensitive account or other personally identifiable information via e-mail. If you receive an e-mail message that appears to come from us that requests such information, please forward it immediately to our Customer Support. We will respond with reasonable speed to help mitigate potential damage.

OTHER WEB SITES

This Online Privacy Policy only applies to our site or mobile equivalents that have adopted this Online Privacy Policy. Our site, however, may include links to other Web sites which are subject to other privacy policies. If you visit another Web site, we recommend that you review the online privacy policy of that Web site to determine how the operator of that Web site will handle personal information collected through that Web site.

For your convenience, for example, we may offer links to online tools which allow you to share content from our site with third parties or sites you select, such as Share This, Facebook, or Twitter. Your use of such tools, sometimes called “widgets,” is subject to the privacy policy applicable to the tool or widget that you use.

POLICY CHANGES

We may revise this Online Privacy Policy from time to time. If we make any material changes to this Online Privacy Policy, the date of the most recent revision will be indicated above so that you can determine whether there have been any material revisions since your last visit.
